Swimming Pool Use Acknowledgment & Release of Liability

The Clubhouse may be locked at times except for the restrooms during pool hours.

Open – 8 a.m. – 10 a.m. Serenity Swim, to 8:00 p.m. | Seven days per week

No lifeguards are on duty. Swimming pool hours and opening/closing dates may be adjusted at the discretion of the Board.

Swimmers swim at their own risk at all times.

Owners, Permittees and Authorized Users are responsible for the safety of their children and guests.

Pool Rules:

  1. Use of the swimming pool area is at the user's own risk and the user assumes all risks. The District and Management Company shall have no liability relating to the use of the pool by any party.
  2. Alcohol is not permitted in the pool area.
  3. No pets are permitted in the Clubhouse, Pool or the Pool Area at any time, except for service animals.
  4. Two guests are allowed per household per day with an Access Fob.
  5. Persons using the pool are encouraged to shower before using the pool.
  6. Individuals using the pool area without supervision must be competent swimmers and behave responsibly. Supervision is not provided by the District or District Management.
  7. Any individual who are incontinent must wear diapers designed by a manufacturer for swimming purposes while in the water.
  8. No oil‐based products (i.e., sun tan oil, baby oil) are allowed in the swimming pool.
  9. Appropriate swimming attire must be worn. Cut‐offs are not permitted.
  10. Running, horseplay or diving into the swimming pool is not permitted.
  11. Loud or foul language and sound‐producing equipment played at an excessive level are not permitted in swimming pool area.
  12. For safety reasons, chairs, lounges, tables, and other items which can obstruct or interfere with access to and from the swimming pool area are restricted to designated areas.
  13. No furniture is permitted in the swimming pool.
  14. Food and beverages may be consumed only at the areas provided with tables/chairs.
  15. The Clubhouse is a drug-free, smoke-free, and tobacco-free environment. No tobacco, marijuana, smoking (vaping), or drug use is permitted in District Facilities. No glass containers of any kind are permitted.
  16. Over‐sized inflatable or flotation devices, including without limitation automobile inner tubes, air mattresses, surfboards, and floating chairs, are not permitted in the swimming pool.
  17. Floating toys, small kick boards, masks and snorkels, noodles, and water shoes are allowed, if not found to be detrimental to the safety or others, but may be prohibited at the discretion of the District.
  18. Hard balls, such as tennis balls and footballs, are not permitted in the pool area.
  19. For safety reasons, during rain, thunder, and lightning storms or other inclement conditions, the swimming pool shall be immediately vacated and shall remain closed until such inclement conditions pass. The District is not responsible for monitoring weather conditions, and each person in the pool area should immediately exit the pool area if lightning or thunder is observed or when directed to do so by an attending lifeguard, if any.
  20. Any person with an infection, communicable disease, open wound, etc., is prohibited from using the pool facilities.
  21. All trash shall be disposed in the proper receptacles.
  22. Any person failing to abide by stated policy or safety rules as contained in the District’s governing documents and/or as posted at the Facilities will be asked to leave the swimming pool area and may have their access rights to the Clubhouse temporarily or permanently revoked as set forth below. The District may also impose fines or penalties for violation of the governing documents.

 

Violations of Pool Rules:

For infractions of the pool rules, the following shall apply:

First infraction of violation of pool rules is a courtesy warning notice.

A second violation, following notice and an opportunity for hearing, may result in a two-week deactivation of the key fob/household access that allowed unauthorized access or otherwise violated the pool rules.

Third and subsequent violations, following notice and an opportunity for hearing, may result in a seasonal lockout (fob deactivation) with a fine.

Additionally, residents and parties whose pool privileges have been suspended (fobs deactivated) and who are subsequently found to be on District property may be reported to law enforcement as trespassing on District property.

Acknowledgment of Pool Use
I understand that use of the District pool is at my own risk and that no lifeguards are on duty. I have received, read, and agree to comply with the District Pool Rules and Regulations, effective May 15, 2025.


Release of Liability & Indemnity Agreement I accept full responsibility for my use of the pool and facilities and for the conduct of my guests. I agree to release and hold harmless the District, its officers, directors, agents, employees, and contractors from all liability, claims, or damages related to my use of the pool.

Emergency Contact

Properties and accounts must be in good standing in order to receive an access fob, there may be no outstanding fines or covenant violations. This document must be on file in order to use the pool facilities.
